Louisiana

Bills have been introduced in the Louisiana state legislature to eliminate failure-to-warn liability claims for Louisiana residents who are exposed to toxic pesticides and are seeking justice.

SB 108 was pre-filed and then pulled from consideration in the Louisiana Senate before the legislative session began on March 9. HB 1158 was filed in the Louisiana House on March 31 and was referred to the House Agriculture, Forestry, Aquaculture, and Rural Development Committee for consideration on April 1. A hearing can be scheduled at a moment's notice!

Florida

History of Failure-to-Warn in this State

Bills have been re-introduced in the Florida state legislature to eliminate failure-to-warn liability claims for Florida residents who are exposed to toxic pesticides and are seeking justice.

The bills were pre-filed in 2025 on November 18 and November 17, 2025, and are likely to begin moving forward once the 2026 legislative session begins on Tuesday, January 13.

HB 443 was pre-filed on November 18, 2025 and referred to Civil Justice & Claims SubcommitteeHousing, Agriculture & Tourism Subcommittee, and Judiciary Committee - it is currently in the Civil Justice & Claims Subcommittee.

The identical bill on the Senate side, SB 518, was pre-filed on November 17, 2025, and referred to the JudiciaryAgriculture, and Rules Committees on December 1, 2025.

Both pieces of legislation failed to move out of committee, effectively defeating the bill!

There is also a separate legislative effort to crack down on free speech as it relates to pesticide and fertilizer use on agricultural lands.

Help stop legislation in Florida (SB 290/HB 433) that will disempower members of the public from speaking out against the potential hazards of pesticide and fertilizer products!

Section 48 of SB 290 was added to this piece of legislation on January 15, 2026, and Section 47 of HB 433 was added on January 17, 2026.

While Section 48 was stripped from SB 290 after a hearing in the Senate Rules Committee on February 10, 2026unfortunately, HB 433 was reported out of the Agriculture & Natural Resources Budget Subcommittee on Wednesday, February 4, 2026, despite public scrutiny. The bill was referred to the House State Affairs Committee, with a hearing likely at a moment's notice!

North Carolina

History of Failure-to-Warn in this State

The bill continues to progress in the North Carolina state legislature to eliminate failure-to-warn liability claims for North Carolina residents who are exposed to toxic pesticides and are seeking justice.

See here for pesticide immunity bill language, Section 19 of S. 639, introduced in the North Carolina Legislature in the 2025 legislative session.

While Section 19 of S.639 was not included in S.401, a conference committee was formed to address discrepancies for the final version of the North Carolina Farm Act.

Once the conference committee makes its decision, the full House and Senate will have to vote on whether to pass legislation that includes Section 19– stay tuned for further updates!
